Welcome to D's Custom Woodworks and Services LLC. These Terms of Service ("Terms") govern your use of our website and woodworking services. By accessing our website or using our services, you agree to be bound by these Terms.
Our Services
D's Custom Woodworks and Services LLC provides custom woodworking, cabinetry, and general contracting services including but not limited to custom cabinetry, built-in bookshelves, finish carpentry, deck construction, and general home maintenance. Our services are subject to availability and may vary by project scope.
Estimates and Scheduling
- Free Consultations: We offer free in-home consultations and project estimates.
- Estimate Validity: Written estimates are valid for 30 days from the date of issuance.
- Project Changes: Changes to project scope, materials, or design after approval may result in additional costs.
- Scheduling: Project timelines are estimates and may be affected by material availability, weather, or unforeseen conditions.
- Cancellation: We request at least 48 hours notice for consultation cancellations or rescheduling.
Pricing and Payment
- Deposits: Most projects require a 50% deposit before work begins, with the balance due upon project completion.
- Material Costs: Material costs are based on current market prices and may be subject to change if there are significant delays between estimate and project start.
- Payment Terms: Payment is due upon completion unless otherwise agreed in writing.
- Methods: We accept cash, checks, credit cards, and bank transfers.
- Late Payments: Late payments may be subject to a 1.5% monthly finance charge.
- Taxes: All prices are subject to applicable sales tax.
Workmanship Warranty
We stand behind our craftsmanship with the following warranty terms:
- Built-in Shelving: 10-year warranty against shelf sagging, lifetime warranty on installation attachment to studs
- Finish Carpentry: Lifetime guarantee on joint integrity, 1-year finish warranty
- Custom Cabinetry: Warranty varies by materials and installation type, specified in project contract
- General Contracting: Workmanship warranty as specified in project agreement
- Exclusions: Warranty does not cover damage from accidents, improper use, modifications by others, or normal wear and tear
- Claims: Warranty claims must be submitted in writing with proof of purchase
Materials and Products
- Material Selection: We source high-quality materials from trusted suppliers, including local Pacific Northwest hardwoods when available.
- Natural Variations: Wood is a natural material with variations in grain, color, and texture. These variations are normal and not considered defects.
- Material Defects: Manufacturer warranties on materials are passed through to the customer.
- Client-Supplied Materials: We can work with client-supplied materials but cannot warranty materials we did not source.
Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about your project needs and site conditions
- Disclose any existing damage, structural issues, or code violations that may affect our work
- Ensure access to work areas during scheduled times
- Remove fragile items from work areas before project start
- Provide adequate utilities (power, water) for project execution
- Follow care and maintenance instructions provided
- Notify us promptly of any concerns during or after project completion
Site Access and Preparation
- Access: Customer must provide clear access to work areas, including parking for work vehicles.
- Pets: Please secure pets during our work hours for their safety and ours.
- Work Areas: We will make reasonable efforts to contain dust and protect your home, but some mess is inevitable during construction.
- Storage: We may need to store materials and tools on-site during multi-day projects.
Liability Limitations
- Pre-existing conditions: We are not responsible for pre-existing structural issues, code violations, or hidden defects discovered during work.
- Concealed conditions: Additional charges may apply if concealed conditions require additional work not included in the original estimate.
- Weather: Outdoor projects may be delayed by weather conditions. We are not liable for weather-related delays.
- Indirect damages: We are not liable for indirect, incidental, or consequential damages including lost time or business interruption.
- Maximum liability: Our total liability is limited to the contract price of the specific service provided.
Insurance and Licensing
D's Custom Woodworks and Services LLC is licensed, bonded, and insured. We carry general liability insurance and workers' compensation insurance for all employees. Proof of insurance is available upon request.
Permits and Code Compliance
- We will obtain necessary permits when required by local building codes
- Permit costs are typically the customer's responsibility unless otherwise specified
- All work will be performed in compliance with applicable building codes
- Customer is responsible for ensuring any client-requested modifications comply with local codes
Change Orders
Any changes to the original project scope must be documented in a written change order signed by both parties. Change orders may affect project timeline and total cost.
Website Use
When using our website, you agree to:
- Use the website only for lawful purposes
- Not attempt to interfere with the website's operation or security
- Not copy, reproduce, or distribute our content, images, or designs without permission
- Provide accurate information in forms and communications
- Not use our contact forms for spam or marketing purposes
Intellectual Property
All content on this website, including text, images, project photos, design concepts, logos, and graphics, is the property of D's Custom Woodworks and Services LLC and is protected by copyright laws. Custom designs created for your project become your property upon full payment, but we retain the right to use project photos for marketing purposes unless otherwise agreed in writing.
Photography and Marketing
We may request permission to photograph completed projects for our portfolio and marketing materials. You have the right to decline. If you agree, we will credit your project in a manner you're comfortable with (or anonymously if preferred).
Dispute Resolution
If you have a concern about our services:
- Please contact us directly to discuss the issue—most concerns can be resolved through direct communication
- We will work in good faith to resolve any concerns promptly and professionally
- For projects with ongoing concerns, we may agree to bring in a neutral third-party inspector
- Any disputes shall be governed by the laws of WA
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
